07/ 13.12.2021 Petitioner has prayed for following reliefs:

"That in the instant writ application petitioner prays for quashing the Judgment dated 1.9.10 passed by Learned Court of Sri Brajesh Kumar Gautam, Addl. Sessions Judge, FTC III, Jamshedpur (Annex-7), whereby and whereunder learned court pleased to dismiss Criminal Appeal No.1 of 1992 due to devoid of merit and the impugned order dt.21.12.91 passed by Sri Sikandar Judicial Magistrate, 1st Class cum Assistant Commandant CRPF, 95th Battalion, Jamshedpur is upheld."

2. Preliminary objection has been raised by the respondent that Civil Writ is not maintainable inasmuch as the petitioner has challenged the judgment of Sessions Judge in civil writ proceeding.

3. In reply to the aforesaid submission, Mr. S .K. Upadhyay, learned counsel for the petitioner prays that this case may be converted as criminal writ case.

4. In view of the limited submission, the instant writ application is hereby disposed of by giving liberty to the petitioner to take appropriate steps before appropriate forum

for the prayer made in the instant writ application.

5. It goes without saying that if the petitioner files any application before the appropriate forum, the delay in filing the case will not come on the way as the matter was pending before this Court.
