02/05.08.2021 The sole appellant along with two others namely Rakesh Pandit and Rajeev Kumar Singh stands convicted for the offence punishable under Section 376(D) and 120B of the I.P.C. and Section 6 of the POCSO Act by the impugned judgment of conviction dated 12.03.2021 passed in Special (POCSO) Case No. 02 of 2019 by the court of learned Special Judge(POCSO), Godda and all of them have been sentenced to undergo R.I. for 25 years with a fine of Rs. 20,000/- each and a default sentence each under Section 376-D I.P.C.; further sentenced to undergo R.I. for 20 years and a fine of Rs.5000/- each with default sentence each under section 120B of the I.P.C. by the impugned order of sentence dated 18.03.2021. No separate sentence has been awarded under Section 6 of the POCSO Act in view of Section 42 thereof. All the sentences were directed to run concurrently.

Call for the lower court record in connection with Special (POCSO) Case No. 02 of 2019 from the court of learned Special Judge (POCSO), Godda.

Office to verify whether other co-convicts have preferred any appeal. Learned A.P.P. would seek instructions as to the status of investigation against accused Nisha Kumari, Mukesh Kumar Mandal and Purushottam Singh and whether they have been charge-sheeted, if so what is the status of the trial and an affidavit to that effect be filed within 4 weeks.
