03/ 07.04.2021 Learned counsel for the petitioners submits that the petitioners are entitled for consideration of their case for Old Pension Scheme as the other similarly situated persons, who have been appointed as Primary Teachers by the same Advertisement, have been considered for old pension scheme. It was only because of the results of the petitioners was published on 18.08.2005, the respondent have rejected the claim of the petitioners for grant of old pension scheme, considering the petitioners in employment after 01.01.2004.

Learned counsel for the petitioners places heavy reliance on the judgment of Hon'ble Division Bench of Delhi High Court, affirmed up to Hon'ble Supreme Court in case of Shyam Kumar Choudhary Vs. Union of India ( SLP No. 31539-2019).

Since no counter-affidavit has been filed, the respondent-State as well as JPSC are directed to file the same, within a period of four weeks.

Put up this case after four weeks.
