1. No one has appeared on behalf of the caveator. As per perusal of the

record of the file, the learned counsel for the caveator has been furnished with

the copy of the appeal on 26.05.2025 by the Registry, in attestation whereof, he

has subscribed his signatures on the index page of the appeal. The notice of this

matter is otherwise deemed to have been made to the learned counsel for the

caveator, as the supplementary cause list-II covering this item dated today, i.e.,

30.05.2025 stands published through the online mode as well as on the notice

board. The caveator, thus, appears to have chosen not to appear despite

opportunity.

2. The caveat stands, accordingly, discharged.

3. Issue notice in the main as well as in the interim application to the

respondent, returnable by the next date of hearing, subject to taking of steps

within a week's period for filing of reply/objections.

4. Heard learned counsel for the applicant/appellant in respect of his prayer

for grant of interim relief and considered his submissions. As herein before

mentioned, the learned counsel for the caveator has not chosen to appear in the

matter. Perused the application, which is supported with an affidavit.

Also perused the memo of main appeal and copies of the documents enclosed

with the same, as Annexures thereto.

5. List on 18.07.2025.

6. In the meantime, subject to any vacation or modification upon

consideration of the objections/arguments and till next date of hearing before the

Bench, the operation of the impugned judgment passed by the learned

Additional District Judge, Jammu on 24.04.2025 shall remain stayed.
