This is an application seeking condonation of delay of 41 days

in filing of the appeal against the judgment dated 17.08.2024.

For the reasons stated in the application coupled with the

submissions made at the bar, the same is allowed. Delay in filing the

appeal is condoned.

Application stands disposed of.

This is an appeal under Section 21 of the NIA Act 2008,

directed against the judgment of acquittal dated 17.08.2024 passed by the

learned 3rd Additional Sessions Judge, Jammu under Section 22 of NIA

Act, whereby the respondent No. 1 has been acquitted and respondent

No. 2, 3 & 4 are therefore proforma respondent and shall be treated as

such.

Heard.

Admit.

Issue post-admission notice

Mr. Mohd. Latif Malik, Advocate waives notice on behalf of

the respondent No. 1.

Registry is directed to send for scanned copy of the record

from the court below.

List for final hearing on 30.10.2025.

Respondent in this appeal was juvenile and now a major,

therefore, he can be served through original process.

Let fresh notice be issued for the service of respondent, to be

served through concerned Police Station.

The office of Ms. Monika Kohli, learned Sr. AAG shall

collect the notice for its onward transmission to the concerned Police

Station.

List as above along with the main appeal.
