This condonation application has been preferred by the applicant
seeking 96 days' delay in filing the above titled appeal.
For the reasons stated in the application coupled with the
submissions made at Bar and in view of no objection from the other side,
sufficient cause for condoning the delay is made out. Application is
allowed and 96 days' delay in filing the above titled appeal is condoned.
This application is disposed of as such.
After considering the judgment of the learned trial court, we are of
the considered view, that, it is a fit case in which leave to the applicant to
file the appeal is granted. Accordingly, leave is granted.
This application is disposed of as such.
Issue notice to the respondents in the appeal, returnable within four
weeks. Requisite steps for service within one week.
