Mr. Eishaan Didhichi, GA for GAD.

Coram: HON'BLE MR. JUSTICE WASIM SADIQ NARGAL, JUDGE
                                   ORDER

24.04.2024 The case is taken out of turn at the request of learned counsel for

the petitioner.

The compliance report filed by Mr. Amit Gupta, learned AAG on

behalf of the respondent-Managing Director (JPDCL), Jammu on 15.03.2024

has been produced by him in the open Court today. The same is taken on record.

Perusal of the said compliance report reveals that the case of the petitioner for

compassionate appointment has already been approved by the Board of

Directors in the 13th meeting in compliance to the direction passed by this Court

on 08.09.2016 and pursuant thereto, the case of the petitioner has been

forwarded to the Administrative Department with the recommendations to take

up the matter with the General Administrative Department (in short, GAD) for

relaxation of age and qualification of the petitioner for her appointment on

compassionate grounds under SRO 43 of 1994.

Learned counsel for the respondents fairly submits that since the

matter has been referred to GAD for age relaxation and qualification of the

petitioner, which requires two weeks' further time to comply with the judgment

in its letter and spirit by issuing a formal order of appointment in favour of the

petitioner on compassionate grounds. Two weeks' time, as prayed for, is

granted, which, however, shall be the last and final opportunity. Let the

petitioner's order of appointment on compassionate grounds be produced before

this Court on the next date of hearing by filing a fresh compliance report. Copy

of the same be also furnished to the learned counsel for the petitioner on or

before the next date of hearing, failing which the Commissioner/Secretary, GAD

shall appear in person.

List again on 15.05.2024.
