01.04.2024

1. The instant contempt petition has been filed by the petitioner seeking implementation of the order/judgment passed by this Court on 24th February, 2020 in WP(C) 444/2020, whereby a direction was issued to the respondent authority to consider and decide the representation of the petitioner, stated to have been filed by him before the respondent authority, forming Annexure-V to the writ petition and the consideration order was required to be passed within a period of two months from the date certified copy of the said order along with complete paper book was made available

2. On being put to notice, detailed statement of facts/compliance report came to be filed on behalf of the respondents and along with the statement of facts/compliance report, the respondents have placed on record detailed order of consideration bearing No. 70-Acctts of 2021 dated 1st June, 2021, whereby, the case of the petitioner was considered in the light of the directions so passed by this Court and was accordingly, rejected.

3. Since the direction passed by this Court was only to the extent of consideration of representation of the petitioner, which stands complied with, as such, nothing remains for adjudication in the instant contempt petition.

4. Confronted with the same, the learned counsel for the petitioner seeks withdrawal of the instant contempt petition, with liberty to challenge the order of consideration dated 1st June, 2021 in appropriate proceedings.

5. In the above background, the instant contempt petition is closed as withdrawn, with liberty to the petitioner challenge the order of consideration supra in appropriate proceedings. Rule, if any, shall stand discharged.
