Through: -

Mr. Ilyas Nazir Laway, GA

CORAM:

HON'BLE MR JUSTICE VINOD CHATTERJI KOUL, JUDGE (ORDER) 26.05.2023

In the instant petition, petitioner prays for the following reliefs:-

"It is accordingly prayed that by an appropriate writ, direction or order including one in the nature of writ of mandamus, the respondents be directed to immediately implement the said recommendation dated 03.04.2013, of State Human Rights Commission, Srinagar and pay the ex-gratia relief in favour of the petitioner/victim family without any further delay. Any other appropriate writ, direction or order be also granted in favour of the petitioner as the Hon'ble Court deems just and proper in the facts and circumstances of the case.

On notice respondents have filed objections, wherein it is stated that the

claim of the petitioner for grant of ex gratia relief on the basis of

recommendations of State Human Rights Commission was accorded

consideration by the Government (Home Department) and the claim of the

petitioner for grant of ex gratia relief/compassionate appointment was found

devoid of any merit. It is further stated that petitioner has no case at all against

the respondents and is not entitled to any relief.

Heard learned counsel for the parties, perused the record and

considered the matter.

Counsel appearing for the respondents relies upon the Judgment passed

by the Division Bench of this Court in OWP No. 1756/2018 along with

clubbed matters. Counsel further submits that the said Judgment squarely

covers the case in hand.

In view of the aforementioned Judgment, which squarely covers the

case in hand, the instant petition is dismissed.

(VINOD CHATTERJI KOUL) JUDGE SRINAGAR 26.05.2023 "Mohammad Yasin Dar"
