                                     ORDER

17.04.2023 Petitioners have filed this petition seeking initiation of contempt

proceedings against respondents for violating the judgment of this Court dated

13.09.2017 passed in SWP No.2258/2017 titled Nishu Pandita & others Vs.

State of J&K and others; judgment dated 01.09.2017 passed in SWP

No.2175/2017 titled Arvind Kumar Wali & others Vs. State of J&K and others;

judgment dated 25.09.2017 passed in SWP No.2355/2017 titled Anjli Zutshi &

others Vs. State of J&K and others; and judgment dated 23.08.2017 passed in

SWP No.2063/2017 titled Deepak Raina & others Vs. State of J&K and others,

on the plea that said writ petitions came to be disposed of on the very first day of

hearing with a direction to the respondent to consider the case of the petitioners

for appointment under the Prime Minister's Special Package for Return and

Rehabilitation Scheme in terms of Advertisement Notice No.01 of 2010 dated

12.01.2010 and 06 of 2010 dated 04.05.2010 within a period of six weeks from

the date of receipt of copy of the order(s).

The petitioners' case is that despite the judgments have been served

upon the respondents, they have not complied with the same and did not

consider the case of the petitioners.

Statement of facts has been filed, wherein it is stated that order dated

23.08.2017 passed in SWP No.2063/2017; order dated 01.09.2017 passed in

SWP No.2175/2017; order dated 13.09.2017 passed in SWP No.2258/2017; and

order dated 25.09.2017 passed in SWP No.2355/2017 have been considered vide

Government Order No.78-DMRR&R of 2017 dated 21.09.2017 (Annexure R-

1); Government Order No.81-DMRR&R of 2017 dated 26.09.2017 (Annexure

R-2); Government Order No.84-DMRR&R of 2017 dated 27.09.2017

(Annexure R-3); & Government Order No.99-DMRR&R of 2017 dated

14.11.2017 (Annexure R-4) respectively. In the statement of facts so filed, it is

also prayed that the contempt petition which is based on mis-representation of

facts, may kindly be dismissed with costs.

From the statement of facts, it is abundant clear that in compliance to

the judgment(s) supra, the case of the petitioners has been considered and their

claims stand rejected. Therefore, there is nothing remains in the instant contempt

petition. Contempt proceedings are, accordingly, closed. However, petitioners

are at liberty to take legal recourse under law available to them against afore

stated government orders.
