ORDER
Judgment dated 23.04.2019 passed by this Court is yet to be
complied with by the respondents. The compliance report filed by the
respondents is more in breach than compliance of the judgment. The
respondents do admit the liability due to the petitioner, however, are putting
forth technical objections for releasing the same. Whatever ought to be done by
the respondents is to be done by them alone and the same cannot be attributed
to the petitioner. Once the respondents accept that the petitioner has executed
the works and the amount has become due to him, there could possibly be no
excuse to deny the legitimate payment due to the petitioner.
Mr. R.S.Jwaml AAG prays for some more time to comply with the
judgment in letter and spirit.
On the request of Mr. Jamwal, AAG, six weeks' as a last and final
opportunity is granted to come up with compliance of the judgment in letter
and spirit, failing which, the Chief Engineer, PHE Jammu and the Executive
Engineer, PHE Division, Kishtwar shall appear in person on the next date of
hearing.
