ORDER
1. This is a petition for initiating contempt proceedings against the
respondents for willful disobedience and non-compliance of judgment dated 24th
August, 2020 passed in WP(C) No.1151/2020. Operative portion whereof reads
as under:-
"6. In view of aforesaid facts and circumstances coupled with the submissions made by learned counsel for the parties, this writ petition is taken up for final disposal at this stage with the consensus of learned counsel for the parties, and is disposed of as follows: -
"Respondents shall accord consideration to the cases of the petitioners keeping in view the judgments dated 19.03.2008 and 05.06.2010 passed in LPA(OW) No. 20/2006 and LPAC No.02 of 2010 respectively and also having regard to the communications bearing No. RRCM/Regd/2019-20/313-14 dated 20.07.2019 addressed by respondent No. 3 to respondent No. 1, communication bearing No. RRCM/Regd/2019-20/742 dated 20.11.2019 again addressed by respondent No. 3 to respondent No. 1, relating to the cases of the
petitioners within a period of two months from the date of passing of this order".
2. On being put on notice, the respondents have caused their appearance
and filed statement of facts/compliance report. Along with the compliance
report, the respondents have also placed on record a detailed consideration order
bearing No.RRCM/Legal/21-22/09-11 dated 30.04.2021 passed by the Relief
and Rehabilitation Commissioner (M), J&K.
3. A perusal of the consideration order reveals that in compliance to the
judgment of this Court, case of the petitioners for registration as migrants has
been considered but the same has been found devoid of merit, hence rejected.
4. In view of the compliance report filed and the detailed consideration
order passed, no case is made out for proceeding against the respondent in
contempt jurisdiction. Proceedings in this contempt petition are, therefore,
closed, leaving it open to the petitioners to work out their remedy against the
consideration order, in accordance with law, if so advised.
