The petitioner questions the order passed in terms of Section 13(4)
of the SARFAESI Act by the respondent No. 3. It cannot be denied that an
equally efficacious remedy of appeal under Section 17 of the said Act is
available to the petitioner. Under the said circumstances, the present writ
petition is not maintainable. Reliance in this regard can be placed upon a
judgment of the Apex Court in the case reported as Phoenix Arc Private
Limited vs Vishwa Bharati Vidya Mandir and others, 2022 SCC Online SC 44.
Writ petition, is accordingly, dismissed along with connected
application with a liberty to the petitioner to avail alternate remedies as are
available under law.
