CORAM:
HON'BLE THE CHIEF JUSTICE
HON'BLE MR. JUSTICE SANJAY DHAR, JUDGE
ORDER
02.09.2021
The petitioners in this writ petition are claiming benefits under the Jammu & Kashmir State Land (Vesting of Ownership to the Occupants) Act, 2001 and the Rules thereunder i.e., the Roshni Act, which has been declared to be ultra vires vide judgment and order dated 9 th October, 2020 in PIL No.19/2011 : Prof. S. K. Bala v. State of J&K and anr.
Since the said Act itself is no longer in existence, the petitioner cannot be granted any benefit on the basis of the said Act.
It appears that the counsel for the petitioner for the above reason has stopped attending the court and has not turned up on last several occasions.
In view of the above, the writ petition is dismissed.
