This application has been filed by

applicant/ respondent No.1 for release of amount of

compensation as per his entitlement in terms of

judgment passed in FAO No.28 of 2014.

Main appeal stands decided on 17.07.2024,

whereby, award passed by the MACT has been

modified.

Appeals preferred by the Insurance

Company as well as applicants, bearing FAO No.28 of

2014 and FAO No.199 of 2015, have been disposed of

vide common judgment dated 17.07.2024 and award

passed by the MACT has been modified.

Learned counsel for the appellant-Insurance

Company, has communicated no objection for

releasing the compensation amount in terms of the

final judgment passed in the aforesaid appeals, but

has prayed that amount refundable to the appellant- Insurance Company in terms of the final judgment, be

also ordered to be remitted to the bank account of the

Insurance Company.

In view of above, amount for which

applicant Manish Kumar is entitled in terms of final

judgment, is directed to be released in his favour

alongwith up-to-date proportionate interest by

remitting the same in his bank account, mentioned in

Para-3 of the application. Photocopies of front pages of

Pass Book has also been placed on record.

The amount, for which appellant-Insurance

Company is entitled in terms of final judgment dated

17.07.2024, passed by this Court in above referred

appeals, is also directed to be released in favour of the

Insurance Company by remitting the same in its bank

account, subject to supplying details thereof to the

Registry by learned counsel for the appellant-

Insurance Company within a week.

Application is allowed and disposed of.
