Learned Additional Advocate General
informs the Court that now the matter has been put
up before Himachal Pradesh Public Service
Commission and the case be taken up on
18.09.2024, by which time the judgment in issue will
be complied within in letter and spirit.
As prayed for, list on 18.09.2024. It is
clarified that in case the judgment in issue is not
complied with in letter and spirit by the next date of
hearing, the erring officer shall remain present in
the Court to explain his conduct. The Court is
making this observation for the reason that the
judgment, execution of which is being sought is
dated 16.05.2023, today we are in the month of
September, 2024. This laxity on the part of the
respondents to comply with the judgment within
.
some reasonable time, not only on one hand
frustrates the very purpose of adjudication, but it
also is reflective of the fact as to how seriously the
officers concerned take the judgments or orders
passed by the High Court. They only need to be
reminded that once the judgment has attained
finality any attempt by any one to overreach the
judgment will be dealt with by the Court with
extreme strictness.
