2. The Letters Patent Appeal No. 338 of 2024
has been filed assailing judgment dated 12.09.2024,
passed by learned Single Judge of this Court in CWP
No. 2130 of 2021, whereby the relief claimed in the
writ petition has partly been allowed in favour of the
appellant granting him benefit of counting contractual

service towards qualifying service for pension under
CCS (Pension) Rules, 1972. However, the prayer to
count such contractual service for grant of benefit of
annual increment has been rejected.
3. Initially, the CWP No. 2130 of 2021 was filed
on behalf of 646 petitioners including the appellant in
LPA No. 388 of 2024. A Coordinate Bench of this Court
had passed order dated 07.05.2021 in following terms:-
"It would be noticed that the present petition has been filed
by as many as 646 petitioners, who are serving in different
parts of the State and are scattered nearly all the 12
districts of Himachal Pradesh.
In such circumstances, the joint petition is clearly
not maintainable and shall be treated as having been filed
only on behalf of petitioner No. 1. As regards the remaining
petitioners, they are at liberty to file individual/separate
petitions.
It is made clear that as and when separate petitions
are filed by the petitioners individually, they shall be
exempted from filing the Court fee of Rs.250/- provided a
copy of this order be annexed with the writ petition.
Since this petition has only been treated as filed on
behalf of petitioner No. 1, therefore, the names of
respondents No. 4 to 6 are ordered to be struck off from the
array of the respondents. Notice. Mr. Bhupinder
Thakur, learned Deputy Advocate, General appears and
waives service of notice on behalf of the respondents. He

prays for and is granted six weeks' time to file reply. List on
25.06.2021."
4. Thereafter, some of the original petitioners in
CWP No. 2130 of 2021 filed their separate writ petitions
on the strength and in pursuance to order dated
07.05.2021 passed in CWP No. 2130 of 2021 inter alia
praying for the reliefs in identical terms as in CWP No.
2130 of 2021. A batch of such writ petitions has been
heard and is being decided together with LPA No. 338 of
2024 in view of involvement of common questions of
facts and law.
5. Since, the relief granted to the appellant in
CWP No. 2130 of 2021 has not been challenged by the
respondents, the petitioners in the batch of writ
petitions being decided hereby also cannot be denied
such relief.
6. Thus, the issue that remains to be
determined is whether the appellant in LPA No. 338 of
2024 and the petitioners in connected batch of writ
petitions are entitled for consideration of period of their

contractual service for grant of benefit of annual
increments?
7. While deciding CWP No. 2130 of 2021,
learned Single Judge has held that the judgment dated
10.01.2020 passed in CWP No. 2411 of 2019 titled as
Jagdish Chand Vs. State of Himachal Pradesh and Ors.,
on the strength of which, the appellant herein was
seeking benefit of grant of increments during period of
contractual services had been assailed by the State of
Himachal Pradesh before Hon'ble Supreme Court and
the same stood disposed of vide order dated
31.10.2023, passed in SLP (C) Nos. 8012-8013 of 2021
in terms of Civil Appeal No. 5148 of 2023 titled as State
of H.P. and another Vs. Sheela Devi. Learned Single
Judge further held that since in Sheela Devi (supra), the
relief was granted to consider the contractual services
as qualifying service for pension only, the relief in
Jagdish Chand's case (supra) had to be construed in
same terms.
8. The only issue considered and decided by the
Hon'ble division bench of this court in CWPOA No. 195
Neutral Citation No. ( 2024:HHC:11126 )
of 2019 titled as Sheela Devi Vs State of H.P and others
decided on 26.12.2019 was "whether the services of an
employee appointed on contractual basis in temporary
capacity can be counted towards qualifying service for
the grant of pension after his services have been
regularised". The question was answered in affirmative.
9. The State of Himachal Pradesh had laid
challenge to above judgment before Hon'ble Supreme
Court by way of CA No. 5148 of 2023 but remained
unsuccessful. The said appeal was disposed of vide
judgment dated 7.8.2023.
10. In a batch of writ petitions with CWP No.
2411 of 2019 titled Jagdish Chand Vs State of Himachal
Pradesh as lead case Hon'ble division bench of this
Court vide judgment dated 10.1.2020 had held the
contractual services rendered by the petitioners in said
batch as Junior Basic Teachers to be counted for
pension under CCS (Pension) Rules, 1972 as well as for
annual increment. The said judgment was also assailed
by the State of H.P. before Hon'ble Supreme Court by
way of SLP (C) Nos. 8012-8013 of 2021, which were

dismissed as withdrawn vide order dated 7.8.2023 in
the first instance. However later, vide order dated
31.10.2023 passed by Hon'ble Supreme Court in MA
Diary No. 40418 of 2023 in CA 5148 of 2023 the SLP(C)
Nos. 8012-8013 of 2021 were restored and thereafter
were ordered to be disposed of in terms of CA 5148 of
2023 titled State of H.P. and others Vs Sheela Devi.
11. Since, in Sheela Devi the issue of grant of
annual increments for period of contractual service was
neither considered nor decided, in our considered view,
the disposal of Jagdish Chand in terms of Sheela Devi
cannot be construed to have set aside the judgment
passed by Division Bench of this Court in Jagdish
Chand (supra) as the issue decided therein with respect
to consideration of contractual service for the purposes
of grant of annual increments was neither discussed
nor decided on merits.
12. The question, as noticed above, has also been
decided by a Coordinate Bench of this Court vide
judgment dated 02.09.2024, passed in LPA No. 232 of
Neutral Citation No. ( 2024:HHC:11126 )
2024 titled as Ram Chand and Ors. Vs. State of H.P.
and Ors., in following terms: -
"39. Accordingly, judgment passed by learned Single
Judge is modified with observation that reasoning assigned
for deciding CWPOA No.5187 of 2020, shall be mutatis
mutandis applicable to the present matter also and
appellants shall be entitled for counting their contract
service for the purpose of pensionary benefits as well as
annual increments for the said period with all
consequential benefits, but restricting actual consequential
financial benefits to three years prior to filing of the writ
petition.

40. Due and admissible benefits shall be released to the
appellants within a period of four months from today.
Needless to say, that benefits given beyond three years
prior to filing of writ petitions shall be extended to them on
notional basis."
13. While deciding LPA No. 232 of 2024 titled as
Ram Chand and Ors. Vs. State of H.P. and Ors. The
Hon'ble Division Bench has taken into consideration
precedents in the cases of Paras Ram Vs. State of H.P.
and another CWP No. 850 of 2010 decided on
19.10.2010, LPA No. 36 of 2010 titled as Sita Ram
Vs. State of H.P. and others decided on 15.07.2010
and CWP No. 8953 of 2013, titled as Joga Singh and

Ors. Vs. State of H.P. and Ors., decided on
15.06.2015.
14. Noticeably, the judgment of this Court in
Joga Singh was affirmed by Hon'ble Supreme Court by
dismissal of SLP(C) No. 183 of 2016 and Review Petition
No. 274 of 2017.
15 The identical proposition again came for
consideration of another coordinate bench of this Court
in LPA No. 314 of 2024 decided on 03.10.2024 (in which
one of us Satyen Vaidya J. was a member). The view in
LPA No. 232 of 2024 titled as Ram Chand and Ors. Vs.
State of H.P. and Ors. was once again affirmed.
16. Apparently, the aforesaid judgments in LPA
No. 232 of 2024 and LPA No. 314 of 2024, were not
brought to the notice of learned Single Judge in CWP No.
2130 of 2021.
17. We do not find any reason to take a view
different than the one taken by the coordinate benches
of this Court in LPA No. 232 of 2024, titled as Ram
Chand and Ors. Vs. State of H.P. and Ors, decided on
02.09.2024 and LPA No. 314 of 2024, titled as Satish
Neutral Citation No. ( 2024:HHC:11126 )
Kumar Banyal Vs. State of H.P., decided on 03.10.2024.
18. Accordingly, we allow LPA No. 338 of 2024
alongwith all the writ petitions. The impugned judgment
dated 12.9.2024 passed by learned single judge in CWP
2130 of 2021 is set aside to the extent the prayer for
grant of annual increments for period of contractual
service was denied. The appellant in LPA No. 338 of
2024 and petitioners in all other connected writ petitions
are held entitled for consideration of their contractual
services not only as qualifying service for purposes of
pension but also for grant of annual increments. It is
further ordered that due and admissible benefits shall be
released to the appellant and petitioners within a period
of four months from today. Needless to say, that benefits
given beyond three years prior to filing of writ petitions
shall be extended to them on notional basis.
19. The Letters Patent Appeal and all other writ
petitions are disposed of in above terms, so also the
Neutral Citation No. ( 2024:HHC:11126 )
pending miscellaneous application(s), if any.
