Patial, Deputy Advocate General & Mr. Rajat Chauhan, Law Officer, for the respondent. Learned Additional Advocate General has apprised
the Court that the submission which was made before the Court
on the last date of hearing that the Letters Patent Appeal (LPA)
filed by the State has been withdrawn, was inadvertently made for
the reason that the LPA, which stood withdrawn was filed against
an interlocutory order passed by this Court in the contempt
proceedings whereas, the LPA that has been filed by the State
against the main judgment is still pending adjudication before the
Hon'ble Division Bench.
Learned counsel for the petitioner submits that State
is following a policy of pick and choose. He states that the
judgment in issue passed by the Hon'ble Coordinate Bench,
disposed of three writ petitions, whereas LPA has been filed by the
State only in the case of the present petitioner. Benefits in terms of
the judgment passed by the Hon'ble Coordinate Bench already
stands released in favour of Sh. Roshan Lal, whose case was
disposed of alongwith the petition.
Learned Additional Advocate General submits that
he may be granted some time to ascertain this fact.
