Notice be issued to the respondent, returnable for

24.11.2023, on takings steps within a period of five days.

By way of instant application, the applicant-

petitioner has prayed for suspension of sentence.

As the main case is pending adjudication, it is

ordered that the substantive sentence imposed upon the applicant-

petitioner, vide judgment of conviction dated 01.04.2023 and order

of sentence dated 03.04.2023, passed by the learned Additional

Chief Judicial Magistrate, Court No.1, Sundernagar, District Mandi,

H.P., and affirmed by the learned Additional Sessions Judge,

Sundernagar, District Mandi, H.P., vide judgment dated

15.06.2023, shall remain suspended, till final disposal of the

petition, however, subject to the applicant's depositing 30% of the

compensation amount before the learned trial Court and also

furnishing personal bond in the sum of Rs.25,000/- with one surety

in the like amount to the satisfaction of learned trial Court, within a

period of six weeks' from today, undertaking therein to appear in

the Court as and when directed and in the event of the dismissal of

the petition, the applicant will surrender before the Court to
