By way of instant application, prayer has been
made by the applicant/petitioner for recalling of orders dated
7.9.2022 and 30.6.2023, whereby interim order came to be passed subject to the applicant's depositing the entire amount of compensation within eight weeks from 7.9.2022. Since
aforesaid order never came to be complied with, this Court vide order dated 30.6.2023, was compelled to vacate the interim
order. No Reply is intended to be filed by the non- applicants/respondents.
For the reasons stated in the application, same is allowed and orders dated 7.9.2022, whereby time of eight weeks
was granted for deposit of the amount and dated 30.6.2023, whereby interim order was vacated, are recalled. However, it is clarified that in case amount is not deposited within one week, orders dated 7.9.2022 and 30.6.2023, passed by this Court shall automatically revive and no further opportunity would be granted to the applicant/petitioner and thereafter, non- applicant/respondent would be at liberty to get the judgment of learned trial court executed in accordance with law. The application is disposed of.
