With the consent of learned counsel for the

parties, the matter is taken up for hearing at this stage.

This writ petition has been filed for the grant of following

reliefs:-

(i) That the inaction of the respondents in not providing the pension to the applicant as

per the ratio laid down by the Hon'ble Supreme Court in Sunder Singh's case may kindly be declared unreasonable, discriminatory, unjustified, invalid, arbitrary and violative of Articles 14, 16, 38 and 39 of the Constitution of India.

(ii) That the respondents may kindly be

directed to grant pension to the applicant w.e.f. 1.1.2018 as per the ratio laid down by the Hon'ble Supreme Court in Sunder

Singh's case, along with all consequential benefits.

(iii) That the respondents may further be directed to release the arrears of

pension/actual monetary benefits to the applicant accordingly w.e.f. 1.1.2018 along with interest @ 18% per annum.

2. During the course of hearing, learned Deputy

Advocate General submitted that the case of the petitioner

& reliefs claimed by him are squarely covered against the

petitioner in terms of judgment dated 21.10.2022 delivered

in CWP No. 3385 of 2019 titled Roop Lal vs. State of

Himachal Pradesh and others. This statement is not

disputed by the learned counsel for the petitioner.

Accordingly, this writ petition is dismissed in light of the

judgment delivered in Roop Lal's case (Supra). All pending

applications, if any, also stand disposed of.
