Mr. Rajan Kahol, Mr. Vishal Panwar and Mr. B.C. Verma, Additional Advocates General with Mr. Rahul Thakur and
Mr. Ravi Chauhan, Deputy Advocates General, for the respondents-State
Pursuant to order dated 16.6.2023, respondents have
come present. Mr. Bharat Khera, Principal Secretary (Pubic Works)
states that the judgment sought to be executed has been laid challenge
by way of an LPA in the Division Bench, which is scheduled to be listed
on 26.7.2023. He states that since the mandate contained in the
judgment sought to be executed, may have huge financial implication,
matter may be deferred till the date of listing of the LPA.
Though, there appears to be no justification to accept the
aforesaid request made by the officer present in the court, but by way of
indulgence, last opportunity of four weeks, as prayed for, is granted to
the respondents to comply with the mandate contained in the judgment
sought to be executed, failing which the respondents shall remain
present in the court, on the next date of hearing, to explain that why
properties of the Department and salaries of the erring officials be not
attached towards execution and implementation of the mandate
contained in the judgment sought to be executed.
