Cr.MP No. 2314 of 2023

By way of instant application, the applicant-petitioner

has prayed for suspension of sentence.

As the main case is pending adjudication, it is ordered

that the substantive sentence imposed upon the applicant-

petitioner, vide judgment of conviction and order of sentence dated

13.09.2022, passed by the learned Additional Chief Judicial

Magistrate, Rampur Bushehar, District Shimla, H.P., and affirmed

by learned Additional Sessions Judge, Kinnaur at Rampur

Bushehar, District Shimla, H.P., vide judgment dated 05.04.2023,

shall remain suspended, till final disposal of the petition, however,

subject to the applicant's depositing 30% of the compensation

amount before the learned trial Court, if not already deposited, and

also furnishing personal bond in the sum of Rs.50,000/- with one

surety in the like amount to the satisfaction of learned trial Court,

within a period of six weeks from today, undertaking therein to

appear in the Court as and when directed and in the event of the

.

dismissal of the petition, the applicant will surrender before the

Court to undergo sentence, if any, imposed by the Court.

Application stands disposed of.

Cr.MP No. 2315 of 2023

For the reasons stated in the application, the same is

allowed. The applicant/petitioner, at this stage, is exempted from

filing the certified copy of judgment and order passed by the ld.

Trial Court. However, the same be filed before the next date of

hearing.
