submitted that he is under instructions not to press this

petition at this stage. He seeks permission to withdraw the

instant petition with liberty to file afresh. Prayer being

innocuous is allowed.

2. Consequently, the instant petition is dismissed

as withdraw with liberty as prayed for. Pending

miscellaneous application, if any, shall also stand disposed

of.
