By way of the present application, the

applicant has sought the indulgence of this Court to

condone 57 days delay, as occurred in filing the main

appeal.

The prayer so made by the applicant has

been opposed by the learned counsel for the respondents

by tooth and nail.

The contents of the application have duly

been supported by the affidavit. As such, the application is

allowed and the delay of 57 days, as occurred in filing the

appeal is ordered to be condoned. The application stands

disposed of.

CMP(M) No.145 of 2023, the delay in filing the appeal has

been ordered to be condoned.

By way of the present application, a prayer

has been made to stay the operation/execution/

implementation of the judgment and decree dated

28.8.2017, passed by the Court of learned Senior Civil

Judge, Court No.2, Ghumarwin, District Bilaspur, in Civil

Case No.136/1 of 2012, titled as HPSEB Ltd. Vs. Raj

Kumar & Another.

The said judgment and decree has

unsuccessfully been assailed before the Court of Additional

District Judge, Ghumarwin, District Bilaspur.

The disposal of the accompanying appeal

will take sufficient long time, as such, during the pendency

of the appeal, operation of the impugned judgment and

decree is ordered to be stayed, subject to deposit of the

entire decreetal amount, if not already deposited, along

with interest, upto date, within a period of eight weeks, from

today.

The application stands disposed of.
