Notice. Mr. Naresh Kaul, Advocate, appears and

waives service of notice on behalf of the respondents.

2. Considering the nature of the order, we propose to

pass, no response is required from the respondents.

3. The petitioner was in service of the respondent-

Himachal Pradesh Tourism Development Corporation Ltd. and

retired as Mason on 31.07.2022 after 22 years of service. It is the

case of the petitioner that his gratuity of Rs.3,27,680/- and leave

encashment of Rs.3,36,960/- have been sanctioned by the

respondents, vide order dated 14.10.2022, Annexures P-1 and P-

2, respectively. The grievance of the petitioner is that despite the

aforesaid gratuity and leave encashment being sanctioned, except

a sum of Rs.1,00,000/- towards gratuity, remaining amount has

not been released.

4. In the facts and circumstances of the case, we

dispose of the writ petition by directing the respondents to release

the remaining admissible retiral benefits alongwith statutory

interest within a period of three months from today, in accordance

with law. If the amount due is not paid within the aforesaid period,

the same shall carry interest at the rate of 9% per annum from the

date it fell due.

5. Pending miscellaneous application(s), if any, also to

stand disposed of.
