Learned counsel for the petitioner submits that

petitioner would be contended in case his case is considered and

benefits to him are extended, in terms of judgment dated

29.06.2022 passed in CWPOA No.7661 of 2019, titled as Pushap

Raj Khimta vs. State of H.P. & others; and judgment dated

10.12.2018, passed in CWP No.2910 of 2018, titled as The State

of H.P. and others vs. Tikkam Ram, as according to the

petitioner, he is similarly situated to Pushap Raj Khimta and

Tikkam Ram.

2. In view of above, respondents are directed to

consider the case of the petitioner in the light of aforesaid

judgments and in case he is similarly situated to the petitioners

referred supra, then similar benefits be extended to him.

3. Needful be done on or before 31.03.2024, by passing

a speaking and reasoned order, after affording opportunity of

personal hearing to the petitioner, if desired so. Order shall be

communicated to the petitioner immediately thereafter.

4. Needless to say that petitioner shall be at liberty to

of avail appropriate remedy for redressal of his grievances, if any,

survive to be adjudicated/redressed after consideration order.

5. Petition is disposed of in aforesaid terms, so also rt pending application(s), if any.
