By way of instant application, a prayer has
been made to place on record certified copy of judgment
passed by learned Sub Judge 1st Class, Baijath, District
Kangra, H.P. on 14th March, 2003 in Civil Suit No. 108 of
2001. It is submitted that on earlier occasion, a similar
prayer was allowed by this Court while allowing CMP No.
9804 of 2016 and the applicant was allowed to place on
record three judgments. The judgment now sought to be
placed on record has also relation to the judgment earlier
submitted as all the judgment are in sequence pertaining
to the same property and same parties.
Learned counsel for the non-applicants has
contested the prayer on the ground that application
cannot be allowed as applicant does not fulfil the criteria
prescribed under Order 41 Rule 27 of the Code of Civil
Procedure.
The objection raised by the non-applicants
appears to be misplaced as the applicant has not made
any prayer for treating the document as additional
documents. His simplictor prayer is to place the
.
document on record.
In this view of the matter, the application is
allowed. The applicant is allowed to place on record
judgment as prayed for in the application, subject to all
just exceptions. The application stands disposed of.
