17.5.2022 Present: Mr.Rajidner Singh Thakur, Advocate, for the

petitioner.

Cr. Revision No. 245 of 2022 Notice to respondent, returnable on

12th July, 2022, on taking steps within five days, be issued.

Cr.M.P. No. 1305 of 2022

Learned counsel for the petitioner submits that out

of total compensation amount of 7,40,000/-, petitioner has

deposited 1,00,000/- in the trial Court during pendency of

appeal before the Sessions Court.

Considering the entire facts and circumstances of

the case and submissions of learned counsel for the petitioner,

substantive sentence imposed upon petitioner No. 2, proprietor

of petitioner No. 1, vide judgment/order dated 22.2.2021,

passed by learned Additional Chief Judicial Magistrate, Court

No. 1, Rohru, District Shimla, H.P. Camp at Rohru in Cr. Case

No. RBT-660/03 of 2019/17, affirmed by learned Sessions

Judge (Forests), Shimla, H.P. in Criminal Appeal No. 4-R/10 of

2021 vide judgment dated 17.2.2022, is suspended, during

pendency of the petition, subject to deposit of

subject to furnishing

personal bond in the sum of 50,000/- with one surety in the
