Learned Law Officer has placed on record the

instructions dated 26.12.2022, the relevant portion whereof

reads as under:

r "In this regard, it is humbly submitted that the

matter of the present petitioner i.e. Sh. Ram Raj Sharma was taken up with the Government vide letter No. EDN-H(2)B(12) Ex. Pet. 22/2022 in O.A. No. 5426/16-

KLU dated 3rd November, 2022. The Government has decided vide letter No. EDN-C-E(4)5/2019-Part-I dated 21st December, 2022 that if the applicants are similarly

situated with the respondents in LPA No. 108 of 2012-1, titled as the State of H.P. Vs. Himachal Pradesh Rajkiya

Prathmic Anubandh Adhyapak Sangh and the Department has already extended the benefit to the aforesaid

respondents, then the Department may contemplate to extend similar benefits to the petitioner. (Copy of Govt. letter dated 21.12.2022 is enclosed herewith).

In compliance to the above further directions have been issued to Deputy Director of Elementary Education Kullu and Una vide letter dated 21.12.2022 (copy enclosed) to similar benefits be given in favour of the petitioners accordingly and compliance be conveyed to this office immediately."

Now that the cases of the petitioners have been sent

to the Deputy Directors, Elementary Education by the Director,

Elementary Education, Shimla, the concerned Deputy Directors

of Elementary Education are directed to expedite the matter

by passing not only the consideration orders but grant the

actual benefits in case the cases of the petitioners are found to

be covered by the judgment rendered in LPA No. 108 of 2012

before the next date of hearing.
