Petitioner has filed this petition under Article 226 of the

Constitution of India, seeking mainly the following relief(s):-

"(i) That writ in the nature of mandamus may very

kindly be issued by directing the respondents to allot the bid and subsequent action should follow.

(ii) That writ in the nature of mandamus may very kindly be issued by directing the respondents not retender the above mentioned Tender work."

2. We have heard learned counsel for the parties and have gone

through the record available on the file carefully.

1 Whether reporters of Local Papers may be allowed to see the judgment?

3. Admittedly, in the present case, the tender notice dated

18.8.2022 was cancelled and thereafter fresh tender notice was issued

on 29.9.2022. The bids in pursuance to the second tender notice were

.

received on 13.10.2022 and financial bids have also been opened on

19.10.2022. Petitioner has also participated in the second tender

process.

4. In this view of the matter, since after the cancellation of the

tender notice dated 18.8.2022, fresh tender notice has been issued

and the petitioner has also participated in the said tender notice, we do

not find it a fit case for invoking the extra ordinary writ jurisdiction under

Article 226 of the Constitution of India.

5. Petition stands disposed of accordingly.

Pending miscellaneous application(s), if any, shall also stand

disposed of.
