Citation : 2021 Latest Caselaw 2980 HP
Judgement Date : 29 June, 2021
Ex. Petition (T) No. 171 of 2020
.
29.6.2021 Present: Ms. Tanvi Chauhan, Advocate, for the petitioner.
Mr. Sudhir Bhatnagar, Additional Advocate General with Mr. Kunal Thakur, Deputy Advocate General, for respondents Nos. 1 and 2.
Mr. Rajinder Thakur, Central Government Counsel, for respondent No.3.
THROUGH VIDEO-CONFERENCING
Learned Additional Advocate General, on
instructions states that the judgment sought to be executed
in the present proceedings, stands implemented, however,
said fact has been seriously disputed by learned Counsel
appearing for the petitioner, who states that though pay
fixation in terms of judgment sought to be executed has
been done, but the petitioner has not been given all the
consequential benefits.
Careful perusal of judgment sought to be
executed in the instant proceedings, clearly reveals that the
respondents were directed to implement judgment dated
26.7.1993 in letter and spirit by granting pay scale of Rs.
300-600 to the petitioners and similarly situate persons
within a period of ten weeks and court also held them
entitled to revision of pay scales effected from time to time, as
such, arrears, if any, payable to the petitioner cannot be
restricted to three years from the date of filing of the petition.
Faced with the aforesaid, learned Additional
Advocate General prays for and is granted two weeks' time to
have fresh instructions. Needless to say, pendency of the
present petition shall not be a bar for the respondents to
.
comply with judgment in question.
List on 20.7.2021.
