By way of this application, a prayer has been

made for release of the amount, on the ground that the

appeal filed by the non-applicant/appellant stands

dismissed by the Court.

Learned counsel for the non-applicant/

appellant submits that as per his instructions, the

appellant intends to assail the judgment passed by

this Court.

Be that as it may, having heard learned

counsel for the parties, this application is disposed of

with the direction that 50% of the amount, which is

presently lying deposited with the Registry of this

Court, be released with up-to-date interest in favour of

the applicants, with liberty to them to approach the

Court afresh for release of the balance amount after

some reasonable time, so that the non-applicants does

get an opportunity to avail its statutory remedy
