1. Heard learned advocate for the applicants. Learned

advocate for the applicants submitted that he has preferred the

First Appeal challenging the impugned judgment and award

dated 25.10.2023 passed in MACP no.192 of 2019 by the learned

Tribunal Kachchh at Bhuj.

2. He further submitted that the said appeal was filed on

belated stage but the application for condonation of delay could

not be preferred in time. Therefore, the said petition came to be

dismissed on the ground of non-removal of office objection. He

further submitted that the application for condonation of delay

could not be received from the Department in time, therefore,

the appeal came to be dismissed for non-removal of office

objections.

3. Having considered the submissions of the learned advocate

for the applicants, the present application deserves to be

allowed. Accordingly the First Appeal is directed to be restored to

its original file. No order as to costs.

4. 10 days time is granted to the applicant to remove the

office objections, if any, thereafter Registry will take necessary

steps.
