1. This appeal is filed challenging the judgment and order of

acquittal passed by the learned Judicial Magistrate, First

Class, Visnagar in criminal case No.1182 of 2003 dated

07-07-2010.

2. Learned advocate Mr.Hiren Modi submits that during the

pendency of this appeal, the borrower of the loan namely

Bhagvandas Tekchand Dhanjani paid up entire dues and

the certificate was also issued by the complainant credit

society namely Hariom Cooperative Credit Society Ltd.

regarding releasing the hypothication/mortgage of the

property.

3. Learned advocate Mr.Modi has placed on record the

communication dated 07-04-2018 addressed to Talati-

cum-Mantri instructing to release the property from

mortgage, same is ordered to be taken on record.

Learned advocate Mr.Modi states that in view of the

above, no grievance survive and appeal be disposed of.

4. On the other hand, learned advocate Mr.Gaurang Patel

submits that respondent No.2 is the guarantor and

principal borrower has paid entire dues, therefore now

present appeal becomes infructuous.

5. In view of the above development, this appeal stands

disposed of as becomes infructuous.
