Though served, none was present for and on behalf of the respondent no.2 and therefore, no arguments on behalf of the respondent no.2.

By this application under section 5 of the Limitation Act, 1963, the applicant seeks condonation of delay caused in filing the Criminal Revision Application No. 791 of 2022 against the judgment and order dated 24.08.2021 passed by learned 3 rd Additional District Judge at Navsari in Criminal Appeal No. 47 of 2019 whereby the learned appellate court has passed an order rejecting the appeal and confirming the order of the learned Magistrate Court, Navsari in Criminal Misc.

R/CR.MA/14652/2022 ORDER DATED: 19/09/2022

Application No. 178 of 2016 on 17.07.2018.

Having regard to the submissions advanced by the learned advocate for the applicant and more particularly considering the averments made in the memorandum of application, the Court is of the view that the delay caused in filing Criminal Revision Application No. 791 of 2022 has been sufficiently explained.

The application, therefore, succeeds and is accordingly, allowed. The delay caused in filing Criminal Revision Application No. 791 of 2022 is hereby condoned.

Present Application stands disposed of. Rule is made absolute.
