For the reasons recorded in the judgment and order passed

today, the Hon'ble Court passed the following order:

"In the result, the appeal is partly allowed. The impugned

judgment and order of conviction and sentence dated 18.02.2013

passed by learned Sessions Judge, [email protected] Godhra in

Sessions Case No. 130 of 2011 is hereby modified by converting

the conviction under Section 302 of Indian Penal Code to that of

Section 304 Part-II of the Indian Penal Code and accordingly the

sentence of life imprisonment is reduced to that of the sentence

of 10 years. The remaining part of the impugned judgment and

order remains as it is.

As the appellant - accused is in Jail since last more than 10

years, he is ordered to be set at liberty forthwith, if not required

in any other case.

The Record and Proceedings are ordered to be sent back to

the concerned Trial Court forthwith."
