                              ORAL ORDER

Mr. Deepak Prajapati, the learned counsel has instructions to appear on behalf of the respondents. Registry is directed to accept the Vakalatnama of learned counsel Mr. Deepak Prajapati on behalf of the respondents herein.

The present appeal is arising out of the impugned judgment and award dated 13.05.2022 passed by the Principal District Judge, Amreli in Regular Civil Appeal No.6 of 2022, whereby, the First Appellate Court has allowed the appeal and thereby reversed the findings recorded by the Principal Civil Judge, Babra in Regular Civil Suit No.9 of 2011.

Mr.Rathin P. Raval, the learned counsel appearing for the appellant submitted that the parties have amicably settle the matter through settlement agreement dated 15.07.2022. The same is produced on record at page no.62.

In view of the settlement arrived at between the parties, nothing further remains in the present proceedings. Hence, the present appeal is disposed of. The judgment and award dated 13.05.2022 passed by the First Appellate Court in Regular Civil Appeal No.6 of 2022 is hereby quashed and set aside. The First Appellate Court is to draw the decree in accordance with the consent terms of the settlement agreement dated 15.07.2022.
