                        ORAL ORDER

1. This is an appeal under Section 37(1) of the Arbitration

and Conciliation Act challenging the judgment and order

passed by the 2nd Additional District Judge, Dahod on

03.12.2019 in Civil Misc. Application No. 45 of 2019.

2. For and on behalf of the appellant - original opponent

nos. 1, 2 and 3 learned advocate Mr. Pandya appears.

According to him, this appeal needs to be withdrawn on

instructions in view of the settlement between the parties

where he has agreed to place no objection to the electricity

connection being given.

C/FA/95/2020 ORDER DATED: 19/07/2022

3. Learned advocate Mr. Ruchir Patel, on instruction,

submits that a specific consent has been given for such

connection.

4. The appeal is permitted to be withdrawn as per his

request. In the event of any electricity connection as may be

requested for by the other side, a regular scrutiny shall follow

where the only concession which will be available is of their

being no objection from the appellant.

5. The appellant has ensured to withdraw the Civil Suit.

According to learned advocate Mr. Patel the withdrawal

pursis has been tendered.

6. In wake of the above, the present first appeal stands

disposed of as withdrawn. Connected civil applications, if any,

stands disposed of in wake of this order.
