1. The applicant is the original petitioner who has

preferred Special Civil Application No. 2641 of 2021 which

has not been listed for long time. Pleadings are over.

2. In case of the very applicant - petitioner, the judgment

has been delivered on the identical issue according to learned

advocate Mr. Soparkar.

3. Learned advocate Mr. Varun Patel appearing for the

respondent has urged that the department is still

contemplating whether to move to the Apex Court for the

appeal or not.
