                   ORAL ORDER

1. Rule. Learned Additional Public Prosecutor waives service of notice of Rule for the respondents.

2. This petition is filed by the petitioner with a prayer to release him on parole leave for a period of 30 days so as to enable him to engage an advocate before this Court challenging the judgment and order of conviction dated 14.07.2021 passed against him.

2. Heard Ms.Manjula Chauhan, learned advocate for the applicant and Ms.Moxa Thakkar, learned Additional Public Prosecutor for the respondents.

3. Learned advocate for the petitioner submits that the petitioner approached the Additional District Magistrate, Rajkot for the grant of parole leave. However, the same was rejected vide order dated 03.09.2021.

4. It appears from the record that the petitioner

is recently convicted by the trial Court vide order dated 14.07.2021.

5. Considering the reasons stated in the application and considering the facts and circumstances of the present case, I am inclined to consider the case of the petitioner.

6. The petition is, therefore, partly-allowed. The petitioner shall be released on parole leave for a period of 15 days from the date of his actual release, on executing personal bond of Rs.5,000/- (Rupees five thousands) before the Jail authority and on usual terms and conditions. The petitioner shall surrender before the Jail authority on expiry of the parole leave, without fail. The Jail authority shall adhere to its own circular relating to Covid-19. Rule is made absolute in the above terms.
