1. Heard learned Advocate Ms. Kirti S. Pathak for the applicant and learned Advocate Mr. Kaash K. Thakkar for learned Advocate Mr. K.K. Thakkar for the opponent Nos. 1 to 6.

2. Though served, nobody appears for the opponent Nos. 7 to 9.

3. By way of this application the applicant has prayed for condoning the delay of 95 days in filing the captioned First Appeal against the judgment and award dated 11.09.2019 passed by the learned M.A.C. Tribunal (Auxi.), Panchmahals at Halol in M.A.C.P. No. 679 of 2017 (Old MACP No.428 of 2006).

5. Considering the submissions made by learned Advocate Ms. Pathak for the applicant and averments made in the application, this Court is of the opinion that reasonable cause is made out for condoning the delay of 95 days in preferring the captioned First Appeal against the judgment and

award dated 11.09.2019 passed by the learned M.A.C. Tribunal (Auxi), Panchmahals at Halol in M.A.C.P. No. 679 of 2017 (Old MACP No.428 of 2006), hence, the delay is condoned. This application is allowed. Rule is made absolute.
