1. Present application has been filed by the applicant for condonation of delay of 36 days occurred in filing application seeking leave to appeal arising out of judgment and order dated 29.08.2019 passed by the 11th Additional Senior Civil Judge and Chief Judicial Magistrate First Class, Surat in Criminal Case No.68279 of 2015.

2. Nobody appears for private respondent, though duly served.

3. Having regard to facts and circumstances of the case and to the contents of the application filed by the applicant, present application for condonation of delay occurred in filing application seeking leave to appeal deserves to be allowed in the interest of justice and accordingly stands allowed. Delay is condoned. Rule is made absolute.
