The appellant herein is the husband who has challenged the order passed by the Family Court, Bharuch in the proceedings under the Guardian and Wards Act, 1890, whereby he wanted custody of minor girl child, then four years old and now 9 years old. The said application came to be dismissed, which is the order impugned herein.

2. Learned advocate Mr. Anurag Agrawal appeared and stated that he has instructions to appear for the respondent wife and would be filling vakalatnama. He inter alia pointed out that proceedings for divorce were filed by the respondent wife which has culminated into decree of divorce between the parties. The said judgment granting divorce is under

challenge before this court in First Appeal No. 3614 of 2019.

3. Having considered the judgment and order impugned in the present appeal and in the totality of facts and circumstances of the case, the court finds it proper to list the present first appeal for hearing alongwith the aforementioned first appeal No. 3614 of 2019. Ordered accordingly.
