1 We have heard Ms. Shruti Pathak, learned Assistant Government Pleader for the appellants and Shri V.D.Parghi, learned counsel for the private respondent on caveat.

2 The learned Single Judge recorded in para 6 of the judgment that the petitioner having been permitted to appear in the walking test by the court's order and she having passed out successfully would be entitled to benefit thereof and accordingly directed the respondents to consider her case for appointment to the post of Forest Guard.

            C/LPA/41/2021                                   ORDER




3     It is not in issue that the petitioner had already

cleared the written test and was eligible to appear in the walking test. As she missed out in the first chance and second chance of the walking test for whatever reasons, she approached this Court whereupon she was granted liberty to appear in the walking test which she successfully passed.

4 In that view of the matter, we do not find any infirmity in the order of the learned Single Judge warranting interference in this appeal. The appeal lacks merit and is accordingly dismissed.

5 Consequently, connected Civil Application stands disposed of.
