1. The learned counsel for the respondent Ms. Kiran D. Pandey informed the Court that the employer's Special Civil Application No.5957 of 1995 has been allowed by the learned Single Judge on 11.01.2018; however, the learned counsel for the workman Mr. Krishnan Ghavariya submits that the Division Bench has allowed the Letters Patent Appeal against the order dated 11.01.2018 on 19.09.2019, against which the employer has filed Special Leave Petition No.118 of 2021, which is pending in the Hon'ble Supreme Court.

2. Presently, the impugned order before us dated 30.03.2015 of the learned Single Judge was passed in Misc. Civil Application No.3658 of 2014 under section 17B of the Industrial Disputes Act in aforesaid Special Civil Application No.5957 of 1995. Therefore, prima facie, the present appeal filed against that order appears to have become

infructuous. However, learned counsel for the workman Mr. Krishnan Ghavariya contends otherwise.

3. Let the copies of the aforesaid two orders dated 11.01.2018 and 19.09.2019, along with the status report of Special Leave Petition No.118 of 2021, be placed before us along with the judgments to be relied upon by the learned counsel for the employer Ms. Kiran Pandey before the next date of hearing. List again on 10.02.2021.
