ORDER IN FIRST APPEAL Having heard learned advocate Mr.Munshaw for the appellant and learned advocate Mr.Amit Thakkar for the respondent, the present Appeal is Admitted.

ORDER IN CIVIL APPLICATION Rule was issued in this Civil Application by Court on 23.9.2019.

2. Today when it comes up for consideration, learned advocate for the respondent stated that pursuant to the judgment and award of the reference Court being 8th Additional

C/FA/4452/2019 ORDER

Senior Civil Judge, Surat delivered in LAR No.36 of 88, the entire amount of compensation awarded by Reference Court came to be deposited and the disbursement of the awarded amount has also been taken place.

3. We are surprised to know as per the statement of learned advocate for the respondent that out of the total amount deposited, 90% of the amount is ordered to be disbursed by learned Judge. Learned advocate for the appellant reacted to the factum of disbursement of 90% of the amount stated by learned advocate for the respondent by responding that he would put the aspect before the officers of the appellant.

The present Civil Application stands disposed of accordingly.
