Heard Mr. G.C. Mazmudar, learned advocate for the applicant.

Mr. Utpal Panchal, learned advocate submits that he has received instructions to appear on behalf of the respondent.

The applicant has preferred present application under Section 5 of the Limitation Act to condone the delay which has occurred in preferring First Appeal to assail the impugned judgment and award of the Commissioner of Workmen's Compensation.

Considering the averments made in this application, the delay is condoned. The application stands disposed of. Rule is made absolute.
