Heard Mr. Ajay R. Mehta, learned advocate for the applicant and Mr. Manraj Barot, learned AGP for respondent No.2. Though served, there is no appearance on behalf of the respondent No.1.

This application under Section 5 of Limitation Act to condone the delay of 40 days which has occurred in preferring an appeal to assail the judgment and order of the Reference Court.
