Heard learned advocate Mr.Jinesh Kapadia for the applicants and learned Assistant Government Pleader Ms.Divyangna Jhala for the respondents.

2. The prayer in this application is to permit deletion of applicant No.1 and to amend the cause- title accordingly.

3. Applicant No.1 - Rambhaben Khodabhai Dalwadi died between the date of the impugned judgment and preferring the First Appeal. It is stated that deceased applicant No.1 has no heirs. The pedigree of the father of the applicant No.1 is annexed with the application.

3.1 It is further stated that the applicants are poor citizens and having no knowledge of law, which delayed in filing of the present application.

4. In view of the death of applicant No.1 and

in absence of any heirs being there, prayer is made for deletion of applicant No.1.

5. In the facts of the case, it deserves to be granted. This application is allowed in terms of prayer 8(B).
